I'm stuck on the fact that a home owner claims to have shot 4 rounds into a door thinking an intruder was on the other side. First, wouldn't a reasonable person in that situation cover the door with the gun and yell to his girlfriend (who he thinks is sleeping in bed) to call the police? Better still, why would an intruder be in the bathroom? He heard noises in a bathroom and thought 'intruder'? In a bathroom? Making noises? What the hell would be stolen?
I would hope that a reasonable juror would apply some critical thinking skills in this situation. He DID kill her. The question is intent, and a prosecutor can never PROVE intent. That comes down to the circumstances of the case... and yes, reason.

Given the stories coming out now of his anger issues and love of guns I have to believe he was drunk / high and was probably trying to kill her after a fight. Or trying to scare her. At the time he probably didn't even realize what he was doing.
Just my guess but it certainly doesn't change the fact that he killed her and should be convicted of first degree IMO.

Well, forget my comment about jurors... apparently, there are none in South Africa. They abolished jury trials in 1969 during apartheid. A judge will hear the case and decide innocence/guilt and decide sentencing. Wow.

One of my partners kept talking about all the problems with the investigation and talking about how he could have thought it was an intruder. I kept interjecting "An intruder who was taking a shit?". I think that's a pretty good trump card for the prosecution. I think I'll email them.

Even CNN had an article on how people in South Africa are terrified at the thought of a home burglary. The main question in his defense for me remains that after he got his gun, why wouldn't he have told her to call the police.

Because they got in a fight and she ran to the bathroom to hide. He then took the gun and killed her...sad
